University attorney Bruce Salzburg on Thursday filed a counterclaim in response to the suit.

The university further stated it would defer the decision to the District Court, asking it to claim jurisdiction over the matter.

The university argues that if the identities were released, high ranking officials of other colleges and universities could in turn decline to apply for the position, and that current candidates could withdraw their names from the applicant pool. The counterclaim does not say why this would be the case.

The Casper Star Tribune, Wyoming Tribune Eagle and The Associated Press are represented by media attorney Bruce Moats, who filed the suit in Albany County District Court. They say the public has a right to know who could soon lead Wyoming's lone public university.
Albany County District Judge Jeffrey A. Donnell has been assigned to the case.
The statement comes more than two weeks after news organizations sued the university so they can get the identities of the finalists when they are chosen. UW President Tom Buchanan has announced he will retire at the end of the year.
He said the identities of those interested in the position are going to become known, unless the university is not performing due diligence by talking to the candidates' current employers.

According to Moats, existing legislation already covers the issue at hand, and the school's request to involve the court in the decision is without merit. Moats said the school is relying on a "catch all" provision that allows the court to decide what should be exempt from public records.
But because the legislation already classifies related documents such as personnel files and applications as confidential, Moats says the legislature has "already spoken."
